Legal conditions

Access to and/or use of www.adea.es, www.adeadigital.es, www.adea.pt and www.adea.com.co and all its subdomains, all of which are henceforth referred to as ADEA DOMAINS, grants the user the status of user of the same, accepting from that moment on and without reservation these Terms of Use, without prejudice to any Special Conditions that ADMINISTRADORA DE ARCHIVOS, S.A., (hereinafter ADEA) may establish for the regulation of certain services and/or content. If the user is under 13 years of age, they must obtain prior permission from their parents, guardians or legal representatives, who will be held responsible for all purposes for all acts performed by the minors under their care.

The user undertakes to use the ADEA DOMAINS in accordance with current legislation, good faith, public order and generally accepted uses and customs.
In addition, the user undertakes not to use ADEA DOMAINS for purposes that are unlawful or harmful to the rights and/or interests of ADEA and/or third parties, and not to cause harm or prevent the normal functioning of ADEA DOMAINS.

The use made by the user of the ADEA DOMAINS will be the user's sole and exclusive responsibility, keeping ADea harmless from any damage and/or harm that may directly or indirectly be caused, to the user himself or to third parties, by the user's failure to observe these Terms of Use. In this regard, ADea reserves the right to deny access and/or use of ADEA DOMAINS or any of their content and/or services, to any user who could or would have breached these Terms of Use.
AdeA informs you that the legal conditions governing the use or the Privacy Policy of the website are expressly and fully accepted simply by accessing the site and/or using its services and contents. Therefore, it is your responsibility to access the legal conditions that regulate the use and privacy of the site on a regular basis in order to know the successive versions that AdeA publishes.

AdeA is not responsible for any damages and/or losses of any nature that the user or a third party may suffer as a result of:
(1) that a third party, in violation of the security measures established by AdeA, uses the ADEA DOMAINS, their contents or services for the transmission of viruses, or agrees to carry out unauthorized processing of the data stored by AdeA;
(2) nor, in general, of any use of the ADEA DOMAINS, their services and/or content that may be made by the user or a third party, contrary to the conditions of access and use of the same established by AdeA. In this regard, ADea reserves the right to deny access and/or use of ADEA DOMAINS or any of their content and/or services, to any user who could or would have breached these Terms of Use.

AdEA is the owner of all industrial property rights to the brand and logo referring to the name AdEA and to the ADEA DOMAINS; just as it is legally authorized to use the AdeA brand, and the use or reproduction of the same is expressly prohibited beyond those expressly provided for in these Terms of Use.

The user's access to the website, the provision of services and the publication of content for use does not in any case imply the transfer, waiver or transfer, in whole or in part, by AdeA of the ownership of the corresponding intellectual and industrial property rights. In fact, under no circumstances may the user make use or use of the website, as well as its contents and services, that is not exclusively personal. With the exception of temporary, transitory or accessory acts of reproduction that form an integral part of the technological process to facilitate your access and enjoyment of the website, no part of it can be reproduced, distributed, transmitted, copied, publicly communicated or transformed, in whole or in part, by any manual, electronic or mechanical system or method (including photocopying, recording or any system for retrieving and storing information) through any medium currently known or that is invented in the future, without authorization from ADEA. If the user's actions or their guilty or negligent omission directly or indirectly attributable to the infringement of the intellectual and industrial property rights of AdeA or third parties - whether there is benefit to the user or not - gives AdeA damages, losses, joint obligations, expenses of any kind, sanctions, coercive measures, fines and other amounts arising or deriving from any claim, demand, action, lawsuit or proceeding, whether civil, criminal or administrative, AdeA will have the right to go against the user by all legal means at their disposal and claim any compensatory amounts, including - but not limited to - moral and image damages, consequential damages and loss of profits, advertising or any other costs that may result in their reparation, amounts of sanctions or convictions, interest on delay, the cost of financing all amounts in which AdeA could be harmed, judicial costs and the amount of the defense in any proceeding in which may be sued by AdeA for the reasons set out above, for damages caused by their action or omission, without prejudice to taking any other actions that may apply to us by law.

AdeA has established a Data Protection Policy (Privacy Policy) that regulates the collection, storage, processing and use of the personal data provided by the user. In this regard, ADea guarantees its compliance with this policy, which can be consulted by the user by accessing the Privacy Policy link that appears in the lower menu of ADEA DOMAINS.

AdEA reserves the following rights:

• Modify all or part of the ADEA DOMAINS, their design, content and/or services, as well as these Terms of Use when you deem it appropriate.
• Interrupt, temporarily suspend or permanently cancel the ADEA DOMAINS or any of the content and/or services that comprise it, at your sole and complete discretion.
• Establish particular conditions and, where appropriate, the requirement of a price or other requirements for access to certain services and/or contents of the website.
• Limit, exclude or condition user access when all the guarantees of correct use of the site are not given by them in accordance with the obligations and prohibitions assumed by them.
• End the provision of a service or supply of content, without the right to compensation, when its use by users becomes illegal or contrary to what is established in the conditions that regulate it.
• Take any legal or judicial action that is appropriate for the protection of the rights of AdeA and of third parties who provide their services or content through the website, whenever appropriate.
• Demand any compensation that may result from the improper or illegal use of all or part of the services and content provided through the website.

AdeA is exempt from any type of liability for damages of any kind in the following cases:

• Because of the impossibility or difficulties of connecting to the communication network through which the website is accessible, regardless of the type of connection used.
• For the interruption, suspension or cancellation of access to the websites, as well as due to the availability and continuity of the operation of their services and/or contents, when this is due to (i) either interruption due to technical maintenance services (ii) or to a cause beyond the scope of AdeA's control, whether it comes directly or indirectly from it.
• AdeA assumes no responsibility for the services and contents, or for the availability and conditions, technical or not, of access to them, that are offered by third party service providers, especially with respect to information society service providers. Information society service providers are understood to be those individuals or legal entities that provide the following services to the public: (i) transmission over a communication network of data provided by the recipient of the service (ii) access services to the said network (iii) Data storage or hosting services (iv) provision of content or information (v) temporary copying service of data requested by users (vi) provision of links to content or search tools.
• For any damages or losses that may be caused by information, content, products and services -with a delimiting but not limiting nature- provided, communicated, hosted, transmitted, displayed or offered by third parties outside AdeA -including information society service providers- through the website through links published on them.
• The processing and subsequent use of personal data carried out by third parties outside AdeA, as well as the relevance of the information requested by them.
• The quality and speed of access to the website and the technical conditions that the user's equipment must meet in order to access the website and its services and/or contents.
• AdeA will not be responsible for delays or failures that occur in the access and/or operation of the services and/or contents of our websites and mobile sites, due to a case of force majeure.

AdEA prohibits the use of hypertext links without permission and the framing of the content available on the Sites and Online Products. Consequently, it reserves the right to disable such elements and expressly disclaims all liability arising from the content available on other websites, services, tools or online applications linked to the ADEA DOMAINS sites and their services. Therefore, the user who accesses any of them will do so under their sole responsibility.

AdeA has no obligation to examine the messages, information or content that users choose to disclose through the Sites and Online Products and, consequently, declines all responsibility related to such publications. Notwithstanding the foregoing, AdeA reserves the right to monitor such content when it deems appropriate, and to reject or remove those that include:

• Illegal, insulting, defamatory, threatening, vulgar, obscene, blasphemous, offensive, aggressive, violent, discriminatory (for ethnic or racial reasons) or censorable for any other reason, including, for guidance but not limited to, content that encourages conduct that may result in civil or criminal sanctions or that violates any applicable local, national or international legislation.
• Announcements or requests of any kind [except on those sites where the publication of advertisements by words is allowed] Messages published under a false identity.
• Messages containing personal data that reveal telephone numbers, Social Security numbers, account numbers, addresses or work references.
• Messages published under a false identity attributable to authorized representatives of AdeA.
• Messages that make it possible to illegally download information that violates privacy or intellectual or industrial property.
• Messages placed in individual folders by the same user and that repeatedly insist on the same argument.
• Concatenated messages of any type.

The parties, expressly waiving their own jurisdiction, accept Spanish legislation as the governing legislation of these Terms of Use, and for the resolution of any disputes or litigation that may arise from them, they agree to submit to the jurisdiction of the Courts and Tribunals of Guadalajara.
